Spediak, LLC Inspection App Terms of Use & Privacy Agreement 

This Terms of Use and Privacy Agreement (“Agreement”) outlines the conditions under which you may access and use the Spediak Inspection App. It also describes how we collect, use, and safeguard your personal data. By continuing to use the App, you acknowledge and accept the terms in this Agreement. 

  1. Acceptance of Terms

 By registering for and using the Spediak Inspection App (“App”), you expressly agree to comply with and be bound by these Terms of Use and Privacy Agreement (“Agreement”). It is important that you carefully read and fully understand these terms before using the App. 

  1. Data Collection and Privacy

 Spediak, LLC (“we”, “our”, “us”) collects the following types of information: 

  • Personal Information: Name, email address, and contact information. 
  • Demographic Data: Information about user demographics to enhance user experience. 
  • Images and Defects: Photos uploaded through the App for defect identification and analysis. These images are automatically analyzed by artificial intelligence (AI) systems to enhance the App’s capabilities and improve both the product and overall user experience. We do not collect or store any specific location information or address data. Users are advised not to upload images that include identifiable locations, addresses, individuals, or any confidential or private information they would not want collected or shared. 
  • Comments: If you leave comments, we collect data shown in the comments form, along with your IP address and browser user agent string to assist in spam detection. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service. The Gravatar service privacy policy is available at: https://automattic.com/privacy/. After approval of your comment, your profile picture may be visible to the public alongside your comment. 

We collect email and contact information specifically to: 

  • Communicate important App updates, policy changes, and service announcements. 
  • Provide personalized user experiences. 
  • Enhance customer support and efficiently respond to user inquiries. 
  • Conduct research and development to enhance the quality, accuracy, and functionality of the App. 
  • Facilitate communication regarding promotional opportunities and updates directly related to our services. 
  1. Non-disclosure and Data Security

 Spediak, LLC does not sell, lease, or rent personal or demographic data to third parties. All collected information, including anonymized data such as hashed email addresses used for services like Gravatar, is strictly used internally for research, development, spam detection, and App improvement purposes. We employ industry-standard security practices to safeguard your information and ensure that anonymized data is handled securely and confidentially. 

  1. Media Uploads

 If you upload images, avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the site or App may download and extract location data from images. Additionally, uploaded images are analyzed using AI technology for the purpose of enhancing the product and user experience. All image processing is performed by automated systems unless manual review is required for system maintenance, debugging, or feature improvements. Do not upload images that reveal identifiable locations, address markers, individuals, or sensitive/confidential information. 

  1. Cookies

 If you leave a comment on our site or App, you may opt-in to saving your name, email address, and website in cookies. These cookies will last one year and are for your convenience so that you do not need to re-enter your details for subsequent comments. Temporary cookies are used during login processes to verify browser cookie acceptance. Login cookies typically last two days, and screen display choices last up to one year. Selecting “Remember Me” keeps you logged in for two weeks. Editing or publishing content sets an additional temporary cookie which expires after one day. These cookie practices may also apply to our mobile or browser-based App versions to ensure consistent user experience and authentication. 

  1. Embedded Content from Other Websites

 Articles on our site or App may include embedded content (videos, images, articles, etc.) from other websites, which behave exactly as if you had visited those websites directly. These external sites may collect your data, use cookies, include third-party tracking, and monitor your interaction with embedded content. 

     6a. Third-Party Services 

 Our App may integrate with or link to third-party services, such as analytics providers, social media platforms, or content embeds. Spediak, LLC is not responsible for the privacy practices or content of these third-party services. We encourage users to review their privacy policies. 

  1. Data Retention

 Comments and associated metadata are retained indefinitely to facilitate automatic recognition and approval of follow-up comments. For registered users, we store provided personal information in user profiles. Users can view, edit, or delete their personal information anytime, except for usernames. Website administrators may also access and modify this information. 

  1. Your Rights Over Your Data

 If you have an account or have left comments, you can request an exported file of the personal data we hold about you. You may also request deletion of personal data we hold, excluding data retained for administrative, legal, or security obligations. However, please note that if we delete your personal data, including your login credentials and account details, you will no longer be able to use the App. This information is required for authentication, login/logout functionality, password recovery, and overall access to the App’s services. 

  1. Data Sharing

 If you request a password reset, your IP address may be included in the reset email. Visitor comments may also be checked through automated spam detection services. 

  1. User Responsibility and Accuracy of Information

 The Spediak Inspection App utilizes artificial intelligence (AI) to assist in defect identification and reporting. However, users acknowledge and agree that the App is intended to be a supplementary tool and is used at their own risk. Spediak, LLC explicitly disclaims responsibility for any inaccuracies, errors, omissions, or misinterpretations in data or defect identification generated by the AI. The AI is not certified or licensed to provide building code compliance or safety certifications and must not be solely relied upon in place of a qualified, licensed inspector or contractor. Users must independently verify and validate all information provided by the App. The accuracy, correctness, and reliability of any report or data generated by the App are solely the user’s responsibility. You are responsible for reviewing and verifying all App-generated content before using it in any official report or disclosure. 

  1. Modifications to Terms

 We reserve the right to modify or revise these terms at any time. Any changes will be effective immediately upon posting. Your continued use of the App following the posting of changes constitutes your acceptance of such changes. 

  1. Termination

 Spediak, LLC reserves the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates this Agreement or is otherwise harmful to other users, us, or third parties. 

  1. Governing Law

 This Agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. 

  1. Indemnification

 You agree to indemnify, defend, and hold harmless Spediak, LLC, its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees and costs, arising out of or in any way connected with your access to or use of the App, your violation of this Agreement, or your infringement of any intellectual property or other rights of any person or entity. 

  1. Children’s Privacy

 Our services are not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us so that we may promptly remove it. 

  1. General Provisions for Online and Technology Applications

 The App is provided on an “as-is” and “as-available” basis. Spediak, LLC does not guarantee uninterrupted access, accuracy, or completeness of the App and its features. See Section 18 for a full disclaimer of warranties and limitations of liability. 

  1. Artificial Intelligence (AI) Usage and Protections

 Users acknowledge that the App incorporates AI technology. Results provided by AI are algorithmically generated and should not be solely relied upon without further review. Users accept full responsibility for reviewing, interpreting, and confirming the accuracy of any AI-generated content or results. 

  1. Limitation of Liability

 To the fullest extent permitted by law, Spediak, LLC shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory.
